1. Operator and Eligibility

TutorPlan is operated by Aleksei Petrov, operating TutorPlan, Vienna, Austria ("TutorPlan", "we", "us"). These terms apply to the TutorPlan app and related services. Contact: tutorplanappteam@gmail.com.
By creating an account or using the service, you agree to these terms. You must be legally capable of entering this agreement. TutorPlan is intended for tutors and similar professionals, not for children to create accounts directly.
2. Service and Licence
TutorPlan helps users organize students, groups, lessons, reminders, payments, balances, and earnings statistics. It is an organizational tool and does not provide accounting, tax, legal, financial, or educational-compliance advice.
While your account remains active and you comply with these terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable licence to use the app for its intended purpose. Apple users also receive the rights required by Apple's applicable licensed-application end-user terms; where required, Apple's standard EULA supplements these terms.
3. Accounts and Security
You must provide accurate information, keep credentials secure, and promptly tell us about suspected unauthorized access. You are responsible for activity performed through your account unless caused by our breach of duty. Supported sign-in methods may include email/password, Google, and Apple.
4. User Content and Student Data
You retain ownership of data and files you enter. You grant TutorPlan only the rights needed to host, process, back up, sync, display, export, and delete that content to operate the service.
You must have a lawful basis and any required authority to enter information about students, parents, or other people. Do not upload unlawful, excessive, infringing, malicious, or highly sensitive information that is unnecessary for lesson administration. For such third-party personal data, you normally act as controller and TutorPlan acts as processor under your documented use of the service.
5. Auto-Renewable Subscriptions
Premium may be offered monthly, every three months, or annually. The purchase screen displays the subscription title, duration, localized price, any eligible introductory offer, and renewal terms before you confirm. Store prices and taxes vary by country and platform; the price shown by Apple App Store or Google Play at confirmation is binding.
- payment is charged to your Apple ID or Google Play account at purchase confirmation;
- the subscription renews automatically unless you cancel through the relevant store before the renewal deadline shown by that store;
- renewal is charged at the then-disclosed store price, subject to the store's notice and consent rules;
- deleting TutorPlan or your TutorPlan account does not itself cancel a store subscription;
- you can restore eligible purchases from the purchase screen.
Promotional or referral Premium does not auto-renew unless you separately buy a store subscription. When free or promotional access ends, the app may limit write features as described in the app while keeping available viewing/export features shown to you.
6. Cancellation, Withdrawal, and Refunds
Manage cancellation through Apple App Store or Google Play settings. Cancellation normally takes effect at the end of the paid billing period. Refund and statutory withdrawal requests for store purchases are handled under the store's process and applicable law. Nothing in these terms waives any mandatory right to a refund, conformity remedy, withdrawal, or other consumer protection.
For Apple purchases, use Apple's purchase-history/refund process. For Google Play purchases, use Google Play's refund and subscription tools or contact us where Google directs the developer to assist.
7. Availability and Service Changes
Internet access is required for authentication, synchronization, purchase validation, and some features. We aim to keep TutorPlan available and protect stored data, but temporary outages, maintenance, store failures, and device restrictions can occur. We may improve, replace, or discontinue features. If a material change negatively affects a prepaid service, we will provide notice and any remedy required by law.
8. Acceptable Use
You may not misuse the service, bypass access or billing controls, probe other accounts, interfere with infrastructure, upload malware, infringe rights, use the service unlawfully, or reverse engineer the app except where applicable law expressly permits it. We may use proportionate technical measures to prevent fraud and protect users.
9. Accuracy and Liability
You remain responsible for checking schedules, payment status, exported records, and tax or business decisions. To the maximum extent permitted by law, TutorPlan is not liable for indirect or unforeseeable loss caused by inaccurate user-entered data, missed reminders, or third-party store/network failures.
These limits do not apply to liability that cannot lawfully be excluded or limited, including liability for intent or gross negligence, personal injury where applicable, mandatory product liability, or breach of statutory consumer rights. Nothing excludes our obligation to provide a digital service in conformity with mandatory law.
10. Suspension, Termination, and Deletion
You may stop using TutorPlan and delete your account at any time. We may suspend or terminate access where reasonably necessary for serious or repeated breach, fraud, security risk, legal requirements, or non-payment, normally with notice where practicable and legally required. Account deletion is described on the Delete Account page and in the Privacy Policy.
11. Mandatory Consumer Rights
If you are a consumer, mandatory protections in your country remain fully applicable, including rules on digital-content conformity, remedies, unfair terms, price changes, and jurisdiction. Contractual language in these terms applies only to the extent permitted by those protections.
12. Governing Law and Disputes
These terms are governed by Austrian law, excluding conflict-of-law rules, but this choice does not deprive an EEA or other protected consumer of mandatory protections of their country of habitual residence. Consumers may bring proceedings in any court available under mandatory jurisdiction rules. Please contact us first so we can try to resolve a concern.
13. Changes to These Terms
We may update these terms for legal, security, provider, or product changes. We will publish the effective date and give appropriate advance notice of material changes where required. Changes do not retroactively remove accrued rights. If consent is legally required, we will request it.
